A definite result for the employee here! Over the past couple of years it has seemed unfair that with petrol prices rising, you were still only able to claim back a maximum of 40p per mile, tax free for business related journeys. hmrc crackdown on scrap metal merchants, construction, fast food outlets and landlords

I have just read that HM Revenue & Customs have just launched a crackdown on scrap metal merchants, construction traders, fast food outlets and landlords to try and recover any undeclared tax. The main focus for the South East seems to be Assessment, PAYE and VAT in our Fast food outlets where businesses are deliberately falsifying their records.

the chancellor reiterated the planned decrease in the main rate of corporation tax to 25% from April 2012

Whilst the Chancellor's Autumn Statement was not intended to be a pre-budget report a few tax points were mentioned. One clear message was that the main rate for Corporation Tax will be reduced to 25% from April 2012 as previously announced. We are expecting the main rate of Corporation Tax to fall further - to 24% from April 2013 and to 23% from April 2014. These reductions are part of the package to achieve the Chancellor's stated objective of making the UK the most competitive tax system in the G20.

Our ‘Olympic Evening’ at Chichester’s Minerva Theatre on 19th December was a great success as Gemma Spofforth, a member of the Great Britain swimming team, a swimming champion, took to the stage and entertained the audience with some inspirational stories. Olympian and former GMTV presenter Andrew Castle interviewed Gemma about her life and hopes for London 2012. Fellow Olympian Mark Foster joined them on stage to talk about his time mentoring the British swimming team throughout the Beijing Olympics and he went on to express his hopes for the swimming team next year.

olympic evening raises funds for charity winston's wish

During our Olympic Evening, at the Minerva Theatre in Chichester on Monday 19th December, we held a special collection for Winston’s Wish and raised £730. It is the leading childhood bereavement charity and the largest provider of services to bereaved families in the UK. Our star guest Gemma Spofforth, a former 100m backstroke world champion and current world record holder, was particularly keen to help raise funds for the appeal as her mother Lesley sadly passed away in 2007. Winston’s Wish provided great support to Gemma and her family at this difficult time. The money collected will go towards helping families and young people, both nationally and in West Sussex.

In the run-up to the show at the Minerva Theatre we ran some promotions with the local media, offering readers the chance to win seats. I am delighted to announce that Spofforths recently entered the Gatwick Diamond Business Awards and our Horsham office is now set to receive a visit from the judges. In the run-up to Christmas Spofforths were nominated for the Corporate Responsibility Award and Business of the Year Award. Today three judges will meet with Spofforths' partners Sarah Ediss and Richard Spofforth, along with our Director of Private Client Services Philip Lansberry.

Based at our Brighton office, Stephanie is currently taking the AAT Level 3 Diploma in Accounting at Brighton and City College. Recognising her hard work and determination, Stephanie’s tutor decided to nominate her for the Spring Awards 2012 which provide an opportunity for students in Sussex to be congratulated for their achievements. Businesses can claim an annual investment allowance – AIA - for capital expenditure incurred on most items of plant and machinery. However, there is a planned reduction in the AIA - to £25,000 from 1 April 2012 (6 April for unincorporated businesses) and many businesses could have to wait over 25 years to benefit from a full tax relief on new plant.

exam success

We are delighted to announce that a number of Spofforths trainees and staff recently passed some tough ICAEW examinations (Institute of Chartered Accountants in England and Wales). Hayley Cleaver who is based at our Chichester office gained top marks in the country in her taxation exams. To mark her achievement she is set to receive The Little Prize from the ICAEW at an awards ceremony on 26th March 2012. Hayley successfully sat the Professional Stage Taxation Examination in December 2011, alongside four other students from Spofforths. James Chapman who works at our Brighton office is also celebrating, having passed the final stage examinations to become a Chartered Tax Adviser. We are very proud of him and all of the trainees who sat exams as they deserve recognition for their hard work.

Despite the somewhat macabre nature of the after dinner talk delivered by renowned expert David Briffett on our local acid bath murderer, John Haig, the evening was a rip-roaring success. David's blood curdling talk had everyone sitting on the edge of their seats. It was preceded by a sumptuous two-course dinner and no doubt due to the content most guests fortified themselves with an extra glass of wine from the bar.

initiatives for taking on young people

Businesses are now being offered incentives to hire young unemployed people as part of the Youth Contract initiative. Employers who take part in the scheme will received subsidies towards those individuals wages of up to £2,275 for every person aged between 18 and 24, hired through the programme. With the youth unemployment figures rising this is a good initiative being launched.

electricians given last chance to declare full income

Over the past few years we have seen a number of industries targeted by HM Revenue & Customs offering individuals the opportunities to declare their full income. It is now the turn of electricians and HMRC have announced that they have issued letters to some 50,000 electricians warning of potential criminal charges as a result of not having disclosed their full earnings. Electricians who make full disclosure now have the advantage of paying a reduced penalty on any undisclosed income. Any individual who think this is relevant to them would therefore be advised to make early disclosure to avoid the adverse penalties and possible criminal action.

On 20 February it was announced that Smartphone's such as iphones and Blackberry's meet the necessary conditions to qualify as a mobile phone thus removing their taxable benefit status.

Gemma is currently competing in the British Gas Swimming Championships, between 3-10 March, and the races are seen as the selection trials for the 2012 Games. Since starring in our Olympic Evening last December she has been training hard for this event which is being held at the Olympic Park in the London Aquatics Centre. Gemma is racing with other top British swimmers as she seeks to secure a place on the GB Team. On the second morning of the trials she eased through the 100m backstroke heats which is a great achievement.

review of tax advantaged employee share schemes

I have just read that the Office of Tax Simplification (OTS) has completed its review of tax advantaged employee share schemes. The OTS has spent its time considering the special tax reliefs available for government approved share schemes such as Save As You Earn (SAYE) and the Enterprise Management Incentive (EMI) scheme. As a result of their review they have recommended introducing a self-certification process, merging the EMI with another scheme called Company Share Option Plans (CSOP) and harmonising definitions, time limits and modifying certain conditions.

reduction in corporation tax announced by Chancellor

One very encouraging piece of news announced by George Osbourne was the reduction in the company’s main tax rate from 1 April this year. Rather than the proposed 26% the rate of tax payable will be reduced to 24%. The Chancellor confirmed that a further 1% reduction will be applied over the next two years meaning that by 1 April 2014, the main rate of Corporation Tax will be only 22%.

It is good news for individuals who earn over £150,000. Today it was announced that from 6 April 2013, the top rate of tax will reduce from 50p to 45p. Sadly, there has been no mention of the personal allowance being made available again to individuals who earn over £100,000 so those with income of that level will still continue to lose their allowances.

Marlborough College, a leading Wiltshire school, recently held their annual careers forum for the lower sixth form (year 12). I was amongst other presenters from 17 differing career opportunities ranging from the Professions to Financial Services and Marketing services companies. I talked to about 50 boys and girls in three interactive sessions helping to give them an insight into the Accountancy professions with all its diverse skills and opportunities. The questions they asked and the feed back survey suggested that it had been well received. My particular session maybe stood out as I was able to give each attendee a "goody bag " courtesy of the ICAEW containing fact sheets detailing the training methods and academic requirements needed to enter a training contract not to mention also containing biros and sweeties !

increase in late issued p35 penalty notices

HMRC have agreed a number of measures to try and stop the increased number of late issued P35 penalty notices. Steps include a change to the date the initial notification to complete a P35 is issued, moving from mid February to mid March, nearer to the end of the tax year. A second reminder at the end of April and an interim penalty notice issued within 1 month of the filing deadline.

ir35 status of an it contractor

I have just read about a recent case won against HMRC. It involved an IT contractor and his IR35 status, something that has again been brought into the press due to the announcements in the budget. The case was brought in front of the first-tier tribunal where it was agreed that the initial phase of his contract with Allianz Cornhill Management Services was as a contractor and therefore IR35 did not apply. It was only when it was clear that Allianz wanted his services permanently did IR35 begin to apply.

Yesterday Mark Spofforth launched the Government review of the Charities Act with Lord Hodgson at the ICAEW headquarters in London. Lord Hodgson has been tasked with a broad review of the Charities Act 2006, including the definition of a charity and the public benefit, the regulation of fund raising, and the accounting rules for charities.

vat refunds for business incurring vat in other eu countries

It is a common misconception that where VAT is incurred by a business in another EU country that this VAT can simply be reclaimed on the company's quarterly UK VAT return. This is not the case. Instead, there is a special procedure in place whereby businesses can reclaim the VAT through HM Revenue & Customs. This process is relatively easy but must be handled outside of their normal VAT returns.

enterprise management incentive scheme - ideal for rewarding, motivating and retaining key staff

An EMI scheme is a good way of retaining a company's key employees in a tax efficient way. A scheme can be put in place whereby options are granted to key employees which can only be exercised (so the shares purchased) once certain criteria have been met - for example, profits levels in excess of £500,000.

hmrc consultation on cash accounting for smaller businesses

Following the budget announcement on a cash basis accounting method for smaller businesses I have today seen a copy of the consultation document in relation to this. The proposals are that businesses with turnover of less than £77,000 will be eligible to account for their income based on the money received, not invoiced. Once they start using this method of accounting they will be able to continue until their total receipts exceed £150,000 in a tax year. Partnerships will be allowed to use this basis also and where an individual has multiple businesses, the cash basis would only apply if all of their businesses were eligible.

Comments on the proposed simplified expenses has also been included in this consultation. Standard mileage rates for business use of cars or motorcycles, flat rate expenses for use of home as office and also a flat rate adjustment for personal use of a business premises have all been included.

Well-known TV presenter Fred Dinenage compared the event at the Hilton Avisford Park Hotel. It was a fantastic evening and a pleasure to see so many businesses being recognised for the achievements they have made despite the tough economic climate. We sponsored the Business Start-Up category and I was delighted to present the winners, Pure Employment Law, with their award. Peter and Nicola have achieved great success since starting Pure in 2010 and look set to build a bright future on solid foundations. This week David Cameron announced that a new fund will be set up to finance charities and social enterprises. Big Society Capital, estimated to be £600m, is a mixture of money from dormant bank accounts and the main High Street lenders. To receive funding social enterprises must prove they can repay an investment through the income they generate.

The Government has revised the National Planning Policy Framework and it’s hoped the new document will make the planning system less complex and more accessible. The aim is to protect the environment and promote sustainable growth. There are clear policies on the conservation and preservation of land within National Parks, Green Belts and Areas of Outstanding Natural Beauty. Outside of these areas authorities are being told to support businesses in rural areas to grow.

We really enjoyed the launch event for the Brighton & Hove Food and Drink Festival which was held at the Hotel Du Vin, in Brighton, on 30 March 2012. Caroline Lucas, who is MP for Brighton Pavilion, opened the festival and talked about the positive impact it will have on the city as it attracts thousands of visitors. The event runs for 10 days and includes The Big Sussex Market and Live Food Show in Brighton on Good Friday and Easter Saturday. It’s held along New Road, Jubilee Street and in the Royal Pavilion Gardens. We hope that you are able to enjoy the festival and sample some of the great local food and drink that is on offer.

It’s always rewarding to see a client make a huge success of their businesses and even hit the headlines. Most recently Ben Fordham, who runs four Mexican Restaurants called Benito’s Hat, caught the attention of the national press after the launch of their fourth restaurant in the new King’s Cross station development. hmrc launch business tax dashboard

HM Revenue & Customs have recently launched a Business Tax dashboard on their website which allows business owners to access HMRCs information more easily. The Business Tax dashboard brings together information from different tax portals. This will include Corporation Tax or Self-Assessment, VAT (if registered) and PAYE (if an employer). The information will include the amount of tax owed as well as the status of any payments or penalties. It will also allow you to amend contact details, including an email address and will be updated each weekend to reflect payments and returns that have reached HMRC within the last 5 working days.

An announcement made in the budget back in April include the concept of a Patent Box. From 1 April 2013 it is proposed that profits generated from Intellectual Property will be subject to a Corporate Tax rate of 10%. This reduced tax rate is designed to encourage more businesses to migrate to the UK who are working in this industry. The consultation carried out on the subject has identified that the lower rate of tax will depend on either when the patent was granted or first commercialised. Further details are to be released later this year and I am keen to see how this proposal is developed to benefit these types of businesses

hmrc are due to release a “business entities test” to help personal services companies assess their risk of being caught by IR35 rules

If you are a personal service company you may be interested to know that HMRC are due to release a new 'business entities test' shortly. This new tool can be used to assess whether or not your company is likely to be at risk of the IR35 rules. By answering a small number of indicative questions you score points and the total score will be reflect whether or not your company is considered to be at a low ,medium or high risk.

hmrc risk assessment for IR35

Following on from my blog last week, HM Revenue & Customs have now released their risk assessment questions in relation to IR35. There are 12 tests ranging from business premises to billing with points being attributed to you based on your answers. The guidance published by HMRC does not confirm whether or not your are caught by the rules governing IR35 but will give an opinion as to whether or not your business is at risk to the legislation. The publication has been heavily criticised by several business groups due to the lack of clarity and fairness in dealing with the issues.h
